Anti-monopoly message
Decree of the President dated 06.07.2020 No. UP-6019 envisages some anti-monopoly regulations as follows:
- Establishment (initiation of establishment) of economic entities with state participation and their affiliated persons and public institutions authorized to carry out economic activities (with the exception of the establishment in order to ensure the defense and national security), is prohibited in the following cases:
- in areas where already there are five or more private sector entities in the commodity market;
- on the part of state bodies in those areas in which they have the authority to license, register, accredit and issue permits;
- For economic entities with state participation, which is the sole supplier or endowed with this right; or holding a dominant (monopoly) position, it is prohibited to create affiliates, the activity of which depends on the use of goods (resources) or the network infrastructure of the founder, and which compete with private economic entities, except the data generation affiliates as a result of their separation with the equal competitors with the terms and conditions of;
- Establishment (reorganization) of economic entities with state participation and its affiliated persons, as well as state institutions authorized to carry out economic activities, (with the exception of the creation for the purpose of ensuring defense and national security), is carried out after obtaining the preliminary consent of the anti-monopoly authority;
- in the state administration bodies, Executive bodies on places, subjects of natural monopolies and economic entities occupying dominant position in commodity or financial market and corporate customers, the annual revenue from the sale of goods over the past three years that exceed 30 billion Soums, an internal system of organizational measures and procedures to ensure compliance with the requirements of competition law, detection and prevention of violations is introduced in the following order:
- From 1st January 2021 for:
Uzbekistan airways;
“Quartz”;
“Asaka” bank;
UzAuto Motors;
“Uztransgaz”;
Navoiazot;
“Thermal Power Plants”;
“National electrical networks of Uzbekistan”;
“Kizilkumcement”.
- From 1st January 2022 for all subjects which fit under the description provided in this section.
