Strengthening the Guarantees of the Rights and Legitimate Interests of Owners
According to the new Law No. ZRU-656 of 23.12.2020, a number of changes to the land legislation was introduced.
In particular, the competences of the Cabinet of Ministers and bodies of state authorities of the seizure of land and termination of ownership rights to land are excluded.
Now enterprises, institutions and organizations interested in the withdrawal of land plots for the construction of enterprises must first reconcile the approximate size of the plot and the conditions for allotment before designing with landowners, land users and tenants, as well as with the khokim or the Cabinet of Ministers.
Now a judicial procedure is being introduced in case of violation of land legislation. Namely, the body that exercises state control over the use and protection of land, having warned the landowner or land user, makes a submission to the body that provided the land plot about the withdrawal of this plot. Further, the body that provided the land plot submits a corresponding statement of claim to the court. In other words, now the land plot can be withdrawn for violation of land legislation only through the court.
