Comparative analysis of the standard airworthiness certificate and the operator’s certificate
- Regulation of airspace use.
- Airspace users.
Users of the airspace of the Republic of Uzbekistan are enterprises, institutions, organizations and citizens of the Republic of Uzbekistan and other states officially registered with the state authorities of the Republic of Uzbekistan and engaged in activities related to the use of the airspace of the Republic of Uzbekistan, namely, flights of aircraft and other aircraft, all types of shooting and missile launches, blasting operations and other activities involving the movement of material in the airspace.
Permission to use airspace.
Activities related to the use of airspace are permitted, subject to the necessary safety measures, only after authorization has been obtained through the Airspace Management Authority (AMA).
The instructions of the Airspace Use Authorities are binding on all airspace users.
Among other things, the use of the airspace of the Republic of Uzbekistan or parts thereof may be prohibited or restricted by the Airspace Management Authorities.
- Civil Aviation.
Civil aviation is aviation designed for:
- transporting passengers, baggage, cargo and mail (air transport);
- performing aviation operations;
- conducting educational, sports, cultural and educational activities, developing technical creativity, and meeting the personal needs of citizens;
- delivery to areas of emergency situations of forces and means to carry out rescue operations, as well as cargo to provide assistance to victims.
Civil aviation used for the above purposes for a fee or for hire shall be recognized as commercial aviation.
Civil aviation not used for the above purposes for a fee or for hire shall be recognized as general aviation.
- Admission to Operation.
Civil aircraft used for commercial purposes shall be permitted to operate if they comply with the standards of airworthiness of civil aircraft, and the aircraft operator shall be issued an aircraft airworthiness certificate.
The aircraft operator shall be responsible for maintaining civil aircraft in a condition that meets the requirements of the certificate of airworthiness.
- Issuance of an operator’s certificate.
An aircraft operator is a legal entity or individual who owns an aircraft and whose ability to operate the aircraft is confirmed by an operator’s certificate;
An operator’s certificate shall be issued by the Aviation Administration in accordance with the procedure determined by the Cabinet of Ministers of the Republic of Uzbekistan. The Aviation Administration shall issue an operator’s certificate in accordance with the procedure determined by the Cabinet of Ministers of the Republic of Uzbekistan.
An Operator’s Certificate may not be issued for two or more legal entities (individuals) and is not transferable to another person. The Operator’s Certificate is issued for a period of 3 years.
- Issuance of an airworthiness certificate.
An airworthiness certificate is a document issued by the Aviation Administration of a state certifying that a civil aircraft complies with the airworthiness standards adopted in a particular state and is capable of performing safe flights under expected operating conditions.
Three types of airworthiness certificate are used in the civil aviation industry of Uzbekistan:
(a) Standard airworthiness certificate;
(b) A special airworthiness certificate;
(c) export airworthiness certificate.
An airworthiness certificate is assigned a number, which consists of two letters defining the type of certificate (CA – standard airworthiness certificate; SC – special airworthiness certificate; EC – export airworthiness certificate) and digits in ascending order.
- Issuance of a Standard Airworthiness Certificate.
A standard airworthiness certificate shall be issued in the following cases:
- after a civil aircraft has been entered into the State Register of Civil Aircraft of the Republic of Uzbekistan (initial issuance of a Standard Airworthiness Certificate);
- the expiration of a previously issued standard airworthiness certificate;
- a change in the category and/or use of a civil aircraft.
A standard airworthiness certificate shall be issued in the form specified in Appendix No. 2 to the Regulations on the Issuance of Civil Airworthiness Certificates, and shall be issued for a period not exceeding one calendar year.
- Issuance of a Special Airworthiness Certificate.
A Special Airworthiness Certificate shall be issued if the civil aircraft and/or flight conditions do not meet the requirements of the airworthiness standards in the following cases:
- the flight of the aircraft to a place where repairs, modifications or maintenance are to be performed, or to a place of storage;
- the aircraft structure or components have damage and/or malfunctions beyond the tolerance or limitations of the type of civil aircraft, which cannot be repaired at the aircraft location;
- evacuation of a civil aircraft from an area threatened by danger or in the event of force majeure;
- in any other cases decided by the Agency.
A special certificate of airworthiness shall be issued in the form set out in Appendix No. 3 to the Regulations on the Issuance of Civil Airworthiness Certificates and shall be valid only for a specific flight and shall confirm that the civil aircraft is capable of safely flying the specified route, taking into account the specified operational limitations specified in the certificate.
- Issuance of an Export Airworthiness Certificate.
An export airworthiness certificate shall be issued when a civil aircraft is placed under the jurisdiction of the Aviation Administration of a foreign state and excluded from the State Register of Civil Aircraft of the Republic of Uzbekistan.
An export certificate of airworthiness shall be drawn up in the form specified in Appendix No. 4 to the Regulations on the Issuance of Civil Airworthiness Certificates and shall be issued by the Agency for a period not exceeding one calendar month.
