Payments to Employees Dismissed Upon the Liquidation of a Legal Entity (Termination of a Representative Office or Permanent Establishment) in the Republic of Uzbekistan

Notes

1.         Unpaid wages Applicable to all employees without exception
2.         Compensation for all unused annual and additional leaves Applicable to all employees without exception
3.         Severance Pay Applicable to all employees without exception The amount of severance pay depends on the length of service with the employer and cannot be less than:

–        50% of average monthly earnings — for employees with up to 3 years of service;

–        75% of average monthly earnings — for employees with 3 to 5 years of service;

–        100% of average monthly earnings — for employees with 5 to 10 years of service;

–        150% of average monthly earnings — for employees with 10 to 15 years of service;

–        200% of average monthly earnings — for employees with over 15 years of service.

If a higher amount is provided in a collective agreement or internal regulations, such amount shall be paid

For certain categories of employees, a special procedure for paying severance pay has been established:

1. Part-time workers — two weeks’ average wages

2. Seasonal workers — 50% of average monthly earnings

3. Temporary workers — not paid unless provided for in the Collective Agreement or Employment Contract

4.         Average salary for the job search period (for the second month)    Applicable to all employees without exception In the amount of the average monthly salary Provided that the employee has not found employment by the end of the second month following termination.
5.         Average salary for the job search period (for the third month) Applicable to all employees without exception In the amount of the average monthly salary Provided that the employee registers with the labor office as a job seeker within 10 days of termination and submits a certificate confirming that they are unemployed.
6.         Compensation in lieu of the notice period Applicable to all employees without exception Monetary compensation equivalent to the notice period The employer is obliged to notify the employee in writing (with a signature) of its intention to terminate the employment contract at least 2 months in advance in case of termination due to the liquidation of the company.

The employer may replace this notice period with monetary compensation corresponding to the duration of the notice period.

7.         Bonuses and Other Incentive Payments Applicable to all employees without exception If, after termination of the employment contract, any payments are accrued to the employee (such as monthly, quarterly, or annual bonuses), such payments shall be made no later than three days after the employee submits a corresponding request.
