The procedure for the seizure of land plots has been changed
On January 10, 2022, the Cabinet of Ministers adopted Resolution No. 14 of 10.01.2022 “On Amendments and Additions to the Regulation on the Procedure for the Seizure of Land Plots and the Provision of Compensation to Owners of Immovable Property” approved by the resolution of the Cabinet of Ministers.
According to this resolution, the protocol on the results of an open discussion should indicate the owners who have agreed or objected to the implementation of investment projects on the territory. During an open discussion, the implementation of an investment project on the site is not allowed if at least one owner objects to the implementation of an investment project on the land plot on which the implementation of the investment project is planned.
The investor now has no right to apply to the court with a claim for the forced sale of an object of immovable property upon receipt of the written consent of 75% of the owners. But the investor can apply to the court with a claim to establish the amount and types of compensation, as well as the timing of its payment to the owners of real estate from whom the investor could not obtain consent.
