Now land in Uzbekistan is a market asset

According to the Decree of the President dated 08.06.21, the land will now become a market asset, passing into private ownership.

In particular, from August 1, 2021, land will be allocated to the private sector on the basis of ownership or lease rights.

State bodies, institutions, enterprises, and self-government bodies of citizens will be allocated land on the basis of the right of permanent use.

The right of lifelong inherited possession, permanent possession, and temporary use is retained by their owners in accordance with the current procedure. It is worth noting that the right of permanent use is not included in this list, which may indicate that this right will not remain with their owners, but may be replaced by the right of ownership or lease.

The allocation of land on the basis of the rights of lifelong inherited possession, permanent possession, temporary use will be canceled.

Agricultural land will be allocated only on the basis of lease rights based on the results of open electronic tenders. Non-agricultural land will be sold through electronic online auctions based on ownership and lease rights.

Starting from August 1, 2021, the powers of khokims to allocate land plots, cancel or change rights in respect of them, establish investment obligations in respect of privatized land plots, and other powers are canceled.

As an exception, the Cabinet of Ministers will have the right to grant land plots directly for rent only in the following cases:

  • to state research and educational institutions for the implementation of scientific research and testing experiments in the field of agriculture;
  • to agro-industrial clusters;
  • for the implementation of a large investment project, determined by selecting the best offer, worth the equivalent of at least 10 million US dollars (increases depending on the size of the land plot) – with the initial placement of funds equal to at least 10% of the project cost in a special settlement account;
  • to enterprises with foreign investments, international associations and organizations, foreign legal entities and individuals-with payment in the market value for obtaining the right to lease.
